    Shipping Costs:

    • $9.90 flat rate for orders under $150
    • Free delivery for orders over $150 

    Shipping Times:

    We only ship within Australia. International delivery is not available.

    • 5 working days for metro locations

    The above times are estimates only, and delivery times will vary depending on your location.

    • All orders are shipped from our warehouse in New South Wales.

    Can I return my order?

     

    If your order has been delivered damaged or incorrect, we will happily organise a refund or replacement within 14 days of receiving the goods.

    Can I exchange my order?

     

    If you are not happy with your order we will try our best to help you, however this is at the discretion of our Customer Service team. We do not exchange or refund for a change of mind.

    For any exchanges of a delivered product, additional delivery charges will be incurred at your expense. Please note that all returned goods must be in their original condition and packaging.

     

    When will I get my refund?

     

    Once the refund has been approved, it takes approx. 7 working days to execute the refund. The refund is then to be made to your payment services provider (for example your credit card supplier).

    The purpose of this Privacy Policy is to inform you how Pernod Ricard Winemakers Pty Ltd of Level 3, 167 Fullarton Road Dulwich South Australia 5067 (ACN 007 070 046) and its affiliates (“Pernod Ricard Winemakers”, “we,” or “our”) collects, stores, uses and processes your Personal Data provided through any Digital Media operated by Pernod Ricard Winemakers. “Personal Data” is information that relates to an identified or identifiable individual.

    1. What Personal Data do we gather about you and how do we collect it?

    Personal Data is collected only for the purposes set out in Section 3 below and each time you participate in any of the features or services offered by our Digital Media.

    The types and amount of information collected for the above-mentioned features and services may be updated and vary depending on the activities of Pernod Ricard Winemakers.

    Subject to applicable law requirements, we may use a variety of technologies that collect and provide information about how our Digital Media is accessed and used by you. We may also use demographic information about the users of our Digital Media, which we may obtain from third parties such as Google or social media that you use (“Usage Information”).  Usage Information may consist of the pages you viewed, the time you viewed them, which beverage information or other content you accessed or provide, in what language, including demographic information about you (such as your age, gender and interest areas, where available) and what pages you looked at before viewing the current page, etc.

    Subject to applicable law requirements, we may also use various tools, including tools provided by third party data processors engaged by us to provide services, that allow us to target the ads we display on social media. Your identity, contact and social media information (i.e. your profile data, social demographics, behavioral data and interests) are processed in this context.

    2. How and why do we use tracking technologies?

    Pernod Ricard Winemakers uses tracking technologies such as cookies, IP Addresses or Log files. Tracking technologies help us tailor our Digital Media to your personal needs.

    • We use cookies to better understand how visitors use our Digital Media and the tools and services offered, and improve their use and functionality. Subject to your consent where required by applicable law, our Digital Media use cookies and similar technologies (“cookies”). Cookies are small files that are placed on your device that serve a number of purposes like letting you navigate between pages efficiently, remembering your preferences, and generally improving your experience. The use of cookies on our Digital Media allows you to enjoy more seamless visits and more accurately measures your behavior on our Site.     • An IP address is a number that is used by computers on the network to identify your computer every time you log on to the Internet. We may keep track of Internet Protocol (IP) addresses to (among other things): (i) troubleshoot technical concerns, (ii) maintain website safety and security, (iii) restrict access to our Digital Media to comply with applicable law or contractual restrictions, and, (iv) better understand how our Digital Media is used.
    • We (or a third party on our behalf) may collect information in the form of logs files that record activity on the Digital Media and gather statistics about users’ browsing habits. These entries are generated anonymously, and help us gather (among other things) (i) a user’s browser type and operating system, (ii) information about a user’s session (such as the URL they came from, the date and time they visited our Digital Media, and which pages they’ve viewed on our Digital Media and for how long), and, (iii) other similar navigational or click-stream data. We also use information captured in log file for our internal marketing and demographic studies, so we can constantly improve and customize the online services we provide you. Log files are used internally only, and are not associated with any particular user.

    3. For what purpose do we use your Personal Data and based on which legal grounds?

    We collect information about you to:

    • Respond to your request for service or for the performance of a contract: When you register or sign-up to our Digital Media, your Personal Data is used to provide you with the relevant features and services you subscribe to, and to offer you the benefits and privileges that typically come along with your registration (e.g. receiving the communications you select at the time of registration, being invited to events, participating in a sweepstake, etc.);
    • Enable you to purchase products on our websites: We use your Personal Data to manage your order and deliver your products;
    • Send you transactional or administrative communications (e.g. confirmation email when you sign up for, or unsubscribe from, a specific registration or activity), as well as certain service-related announcements (e.g., notices about updates to our privacy notices, discontinued features or programs on our Digital Media, changes to our online services or technical support policies, or other related changes);
    • Allow us to send you marketing information when you consent:
      • In addition to the purpose for which you submitted your Personal Data, you may also be given the option (through a check box or otherwise) to have your Personal Data used for an activity or service different from the primary activity or service that you are requesting. For example, if you are signing up for a contest or other promotion, you may also be invited to sign up for newsletters or alerts from our Digital Media hosting the promotion or from other websites. If you choose to receive these additional services, we will use your Personal Data to provide them to you;
      • When you use a QR Code or equivalent feature displayed on Pernod Ricard Winemakers products, we use your Personal Data to send you more information on the products where the QR code or equivalent feature is displayed or other products;
    • Better serve you because it is also in Pernod Ricard Winemakers’ legitimate interest:
      • Subject to your consent when required, we may occasionally combine, update, or otherwise enhance the Personal Data collected through our Digital Media with data we receive from outside records or third parties. For instance, we may combine, or engage a trusted third party to combine on our behalf, purely demographic or survey information (e.g. age, gender, household information, and other interests, etc.) not linked to any Personal Data about you with Personal Data collected though our offers (such as during account registration) and our Digital Media;

    We may use the combined above-mentioned information and/or demographic information for our internal marketing and demographic studies and to constantly improve, personalize, and customize the products and services we provide you to better meet your needs. Some of the tools we use may involve automated individual decision-making subject to applicable law;

    We may use the combined above-mentioned information and/or demographic information to display targeted ads about Pernod Ricard products and services on the social media you are registered on and for measuring ad performance. If you do not object to the use of your Personal Data for targeted advertising purposes, we will transfer your Personal Data that has been through a process of encryption known as ‘hashing’ to the social media whose marketing tools we use (see section 5 below), this hashed data may including (but is not limited to your surname, first name, contact details and date of birth. Subject to your consent, social media can also identify you through the cookies placed on our Digital Media. Once your data is shared on social media, it is used to enable such media, subject to your consent, to find you among other users, and (i) to show you ads about our products and services when you browse the relevant social media, and (ii) to identify, based on your profile on the relevant social media (where you live, age, gender, language, socio-demographic characteristics, interests and behavior), lookalikes who may also be interested in Pernod Ricard ads. Social media also provide us with reports on the results of our advertising campaigns (click-through rate, conversion rate, audience profile, etc.) to enable us to improve our future campaigns. In the context of these activities, we act as a joint controller together with each social media and as a controller of any third party data processors that we engage for relevant support services, including to assist with targeting and managing our social media marketing campaigns. We do not, however, collect or access at any time the Personal Data concerning you held by the social media concerned and relating in particular to your profile or your behavior on such social media. This type of Personal Data processing is based on our legitimate economic interest in offering relevant advertising content on social media, tailored to a specific audience.

    Feedback, questions, or comments through our “Contact Us” form and our “Tell Us” compliance reporting system: if you contact us via an online contact form, your Personal Data is used to respond to your inquiry or comment;

    • We will ensure that your Personal Data remains accurate and up-to-date and avoid duplication in our database, by verifying each of your interactions with us and/or one of our affiliates to ensure your  Personal Data is still accurate or needs to be completed or updated with the additional information you will have provided; and
    • We may conduct profiling based on monitoring your browsing activities on our Digital Media to better understand your preferences and center of interests and adapt our marketing communications to your profile, unless you object in the conditions set forth in Section 9 of this Privacy Policy.

    Pernod Ricard Winemakers may process Personal Data involving automated decision making, including for the performance of a contract (e.g. avoid fraudulent payment) or subject to your explicit consent, to better serve your needs in accordance with your preferences.

    Please note that the automated tools used are regularly checked to ensure that the Personal Data is processed fairly. Specific measures such as data minimization are implemented when creating profiles. You are invited to express your point of view through the right of access described above. You can also object the result of the automated decision by sending an email to the contact details in Section 11 below.

    4. What happens if you do not wish to provide your Personal Data?

    If you choose not to submit any Personal Data when requested, you may not be able to participate in certain activities and personalized features, or the Digital Media services and specials offered to you may be limited. For example, if you refuse to share your email address, you will not be able to receive our newsletters or otherwise register on our Digital Media. However, to simply browse our Digital Media and learn more about Pernod Ricard Winemakers and our products, you do not need to give us any Personal Data, although our cookies may still operate if you have not disabled them. In any event, we will always inform you of the Personal Data that is necessary in order to benefit from a service.

    5. To whom do we disclose your Personal Data and why?

    • Within the Pernod Ricard Winemakers Group

    Pernod Ricard Winemakers may share for the purposes mentioned in Section 3 your Personal Data within the Pernod Ricard Group, including its affiliates worldwide.

    • With third parties

    Pernod Ricard Winemakers may also share your Personal Data with third parties, but only in the following circumstances:

    • For marketing purposes, if you gave us your consent;
    • For targeted advertising purposes: we share your Personal Data with the following social media: Facebook, Instagram, Twitter, to display targeted ads on them about our products and services to you and people with a similar profile to you. In this context, the social media and Pernod Ricard are acting as joint data controllers. For more information about how such social media process your Personal Data and on how to exercise your rights with them in connection with any further processing of your Personal Data, we invite you to view their privacy policy on their websites;
    • For support purposes: We may use service providers, agents or contractors to provide support for the internal operations of our Digital Media and to assist us with administering them or the various functions, programs and promotions available on it. We also use third party customer data platform service providers to help us to better understand our customers and their preferences to assist with targeting our advertising and marketing, including advertising and marketing on social media. As set out at section 9 of this Privacy Policy, you can object at any time to your Personal Data being processed for direct marketing purposes; for marketing purpose based on profiling; and/or for the purposes of targeted advertising on social media. Any such third party shall at all times provide the same levels of security for your Personal Data as Pernod Ricard Winemakers and, where required, are bound by a legal agreement to keep your Personal Data private, secure and to process it only on the specific instructions of Pernod Ricard Winemakers;
    • For joint and co-sponsored programs and promotional purposes: When we run a joint or co-sponsored program or promotion on our Digital Media with another company, organization, or other reputable third party; and, as part of this event, collect and process Personal Data, we may share your Personal Data with our partner or sponsor, subject to your consent when required. If your Personal Data is being collected by (or is shared with) a company other than Pernod Ricard Winemakers as part of such promotion, we will let you know this at the time your Personal Data is collected;
    • For litigation and safety purposes: We may also disclose your Personal Data if we are required to do so by law, or if in our good faith judgment, such action is reasonably necessary to comply with legal processes, to respond to any claims, or to protect the safety or rights of Pernod Ricard Winemakers, its customers, or the public;
    • In the event of a merger or acquisition of all or part of Pernod Ricard Winemakers by another company, or in the event that Pernod Ricard Winemakers were to sell or dispose of all or a part of the Pernod Ricard Winemakers business, the acquirer would have access to the information maintained by that Pernod Ricard Winemakers business, which could include Personal Data, subject to applicable law. Similarly, Personal Data may be transferred as part of a corporate reorganization, insolvency proceeding, or other similar event, if permitted by and done in accordance with applicable law

    6. Is your Personal Data sent to recipients located in other countries and why?

    Pernod Ricard Winemakers is a global company and your Personal Data may be transferred across international borders. It may be transferred to countries that have a different level of data protection laws than the one existing in the country from where you submitted your Personal Data. Your Personal Data may also be transferred between different companies of the Pernod Ricard Group located in different countries. Pernod Ricard Winemakers takes the appropriate measures to maintain security of the Personal Data both during transit and at the receiving location by implementing contractual clauses as set out by the European Commission, in accordance with applicable law.

    Our main service providers for the operation of our Digital Media are based in the United States. The transfer of personal data to these service providers are implemented in accordance with applicable laws and rely on standard contractual clauses as set out by the European Commission or on the Privacy Shield. Such service providers are also bound by a contract that ensures a high standard of privacy protection and requires (amongst other provisions) that they act only on Pernod Ricard Winemakers’ instructions and implements all technical measures necessary on an ongoing basis to keep your Personal Data secure.

    7. How long do we keep your Personal Data?

    We will store the Personal Data that you send us via our Digital Media in our databases as long as your account is active, for the duration of the contract with you or as needed to provide you the services you requested or to answer queries or resolve problems, provide improved and new services. We may also retain your Personal Data in accordance with our internal retention procedure as necessary to comply with our legal and regulatory obligations, resolve disputes and enforce our agreements.

    We may thus retain your Personal Data after you stop using Pernod Ricard Winemakers services or our Digital Media according to the statute of limitations or other mandatory retention periods.

    8. How do we secure your Personal Data?

    Pernod Ricard Winemakers takes all necessary technical and organizational measures to protect the confidentiality and security of your Personal Data collected from this website and/or our applications, including sensitive Personal Data. These efforts include but are not necessarily limited to: (i) storing your Personal Data in secure operating environments that are not available to the public and that are only accessible to authorized Pernod Ricard Winemakers employees, and our agents and contractors; and, (ii) verifying the identities of registered users before they can access the Personal Data we maintain about them.

    9. What are your rights regarding your Personal Data?

    • If your Personal Data has been processed on the basis of your consent, you can withdraw your consent at any time.

    • You can object at any time to your personal data being processed for direct marketing purpose, for marketing purpose based on profiling, for the purposes of targeted advertising on social media.

    • You can request to access your Personal Data.

    • You can request to rectify your Personal Data if it is inaccurate, incomplete or out of date.
    • You can request the erasure of your Personal Data: (i) if your Personal Data is no longer necessary for the purpose of the data processing; (ii) you have withdrawn your consent on the data processing based exclusively on such consent; (iii) you objected to the data processing; (iv) the Personal Data processing is unlawful; or (v) the Personal Data must be erased to comply with a legal obligation applicable to Pernod Ricard Winemakers. Pernod Ricard Winemakers will take reasonable steps to inform the other entities of the Pernod Ricard Group of such erasure.
    • You can request the restriction of the processing: (i) in the event the accuracy of your Personal Data is contested to allow Pernod Ricard Winemakers to check such accuracy; (ii) if you wish to restrict your Personal Data rather than deleting it despite the fact that the processing is unlawful; (iii) if you wish Pernod Ricard Winemakers to keep your Personal Data because you need it for your defense in the context of legal claims; (iv) if you have objected to the processing but Pernod Ricard Winemakers conducts verification to check whether it has legitimate grounds for such processing which may override your own rights; or (v) if the data processing is based on the legitimate interest of Pernod Ricard Winemakers.
    • You can request the portability of the Personal Data you provided to us, in particular if the Personal Data processing is based on your consent or the performance of a contract.
    • You always have the option not to share any of your Personal Data with us. If you choose this option, you may be limited in the activities and features we can provide you.
    • You have the right to object to the processing of your Personal Data by us, including for marketing purpose based on profiling.

    According to the local law, you may also have the right to give general or specific instructions on how your Personal Data processed under this Privacy Policy may be used after your death.

    10. How we treat children’s Personal Data?

    Our Site is not intended for children under the legal drinking age (“Minor”), so we do not knowingly collect personal data from Minors. You must be at least eighteen years old to create an account and engage in activities and transactions on our Digital Media. If we are notified or learn that a Minor has submitted Personal Data to us through our Digital Media, we will delete such Personal Data.

    Terms & Conditions of Sale

    1.  General

    1.1. In these Terms, the following definitions apply:

    “Customer” means the person, to whom Products are supplied;

    “Australian Consumer Law” means the Australian Consumer Law (as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth));

    “Order” means an order for a Product placed by a Customer:

    “Product” means any of the products, available for purchase via the Website;

    “Terms” means these Terms and Conditions of Sale;

    “We” or “Us” means Pernod Ricard Winemakers Pty Ltd ABN 75 007 870 046 trading as Pernod Ricard Winemakers;

    “Website” means https://order.winning-drinks.com/.

    1.2. These Terms may be varied by Us from time to time at our sole and absolute discretion.

    1.3 Purchases made via the Website are made under South Australian Liquor Licence No 57703968.

    1. Prices

    2.1. The prices charged by Us for Products may be altered at any time without advance notice.

    2.2. Product prices quoted are in Australian dollars and include GST and all other taxes and duties, but exclude freight. 

    1. Orders

    3.1. When placing an Order with Us, you confirm that all the details that you have provided in completing the Order are true and correct and that you offer to purchase the Products pursuant to the Order.

    3.2 It is a condition of purchase that you verify that you are 18 years of age or over. All Orders are subject to acceptance by Us.

    3.3. Supply of Products is subject to availability and to any Order minimums and limits imposed in respect of a Product by Us. We may, in our sole discretion, waive the application of an Order minimum or limit in respect of an Order.

    3.4. The Customer cannot cancel an Order nor delay delivery of Products pursuant to an Order once an Order has been accepted, unless We provide our consent.

    3.5 We may, at our discretion, substitute alternative Products or vintages of a similar value or style if a Product (or a particular vintage) is not available.

    3.6 All specials, promotions, clearances, offers and discounted items are subject to their specific terms and conditions (including the terms set out at clause 16) and are whilst stocks last unless otherwise indicated.

    1. Delivery

    4.1.Orders will be delivered to the address (Delivery Location) provided by You at time of check-out.

    4.2 The freight cost for an Order will be displayed at check-out.

    4.3.  Risk of loss of or damage to the Products in an Order passes to the Customer upon delivery of those Products.

    4.4.  We may consign or ship an Order to the Customer in instalments at varying times.

    4.5. We are not responsible for and do not accept liability for delay or non-delivery of products. In the case of late delivery, the Customer must accept Products delivered pursuant to that Order.

    4.6 If the Customer is not at the Delivery Location at the time of delivery of an Order, the Products delivered pursuant to the Order may be left with a person at the Delivery Location who is 18 years or older who may be required to show proof of age. In the event that nobody is at the Delivery Location who meets the criteria under these Terms, a waiting card will be left at the Delivery Location. This waiting card will advise the next steps required to obtain delivery of the Products pursuant to the Order. Products will not be delivered to a person under the age of 18 years (proof of age may be required in the sole discretion of the delivery person or Us). We cannot agree to leaving unattended deliveries in any circumstances.

    4.7 Orders are dispatched Monday – Friday. If we are in stock of a Product when an Order is received, we will aim to dispatch that Order the next business day. We do not accept requests to delay dispatch of Orders.

    4.8 Each Order may only request that the Products pursuant to that Order be sent to a single Delivery Location. If you need to send Products to more than one Delivery Location, you will need place a separate Order for each Delivery Location. Once an Order has been completed, the Delivery Locations cannot be changed. Please contact Customer Service with any queries or changes and they will try their best to accommodate you.

    1. Payment

    5.1 Payment is required when an Order is placed.

    5.4 We will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by anyone whose payment card information is fraudulently used or is used in an unauthorised manner in connection with payment, collection, use, disclosure or transmission of that payment card information via the Website or otherwise in regard to a transaction made via the Website.

    1. Returns

    6.1. The Customer’s rights and our obligations under the Australian Consumer Law are not affected by these Terms. Under the Australian Consumer Law, our Products come with guarantees (“Consumer Guarantees”) that cannot be excluded. Customers are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

    6.2. In the event that any Products provided to fulfil your Order are faulty, damaged, wrongly described or breach a Consumer Guarantee we will refund your money or exchange the Product upon presentation of your proof of purchase. If your Order incurred a delivery fee, then we will cover the cost of delivery for the return only where We are at fault, that is in the following circumstances:
    • if the wrong Product is delivered;
    • the Product is faulty (including any damage caused in transit); or
    • We have breached a Consumer Guarantee.
    In all other circumstances, including change of mind, the delivery charge will be deducted from the refund to the Customer.


    6.3. Unfortunately, you cannot amend an Order after it has been placed, nor can you amend/exchange/claim a refund on a Product that is damaged by you. If you have any queries about pricing or promotions, please contact the Customer Service team prior to placing your order as refunds or pricing changes will not be implemented retrospectively once an Order has been placed. If you change your mind after placing your order, please contact our Customer Service Team during business hours, exchanges may be made at our discretion. For exchange of a delivered Product, additional delivery charges will be incurred at your expense. All Products returned due to a change of mind by the Customer must be in their original condition and packaging.

    7.1. We may make changes to the contents of this Website, or to the Products and services described, at any time without notice. The Website contents may be out of date, and We makes no commitment to update the contents. We do not warrant the accuracy and completeness of the contents of the Website.

Subject to any relevant statutory provisions, including the Australian Consumer Law, these Terms contain the entire agreement between Us and the Customer on the subject matter and all representations, warranties and agreements (whether express or implied and whether statutory or otherwise) are expressly excluded and our liability is limited to the lesser of:

    • the cost of replacing the Products provided to fulfil an Order; or
    • the cost of obtaining equivalent Products.

    1.  Promotional Vouchers

    Promotional vouchers cannot be exchanged for cash, used in conjunction with one another, re-used on another transaction, or partially used across multiple Orders.

    1. On-Supply of Products

    11.1. The Customer must not sell or solicit sales of Products.

    11.2. The Customer must indemnify Us against all claims, actions, liabilities, charges, expenses, losses damages and costs (whether incurred by or awarded against Us) arising out of or in connection with a breach of clause 11.1 by the Customer.

    1. Responsible Service of Alcohol

    We support the responsible service and consumption of alcohol and recommend that alcohol be enjoyed in moderation. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. The Customer therefore warrants that the Customer is18 years of age or over; and that any person the Customer is  obtaining the Products for is also 18 years of age or over.

    1. Applicable Law

    14.1 These Terms are governed by and construed in accordance with the laws of the state of South Australia and are subject to the non-exclusive jurisdiction of the courts of South Australia.

    14.2 Nothing in these Terms is intended to contravene any applicable law. To the extent that any provision in these Terms is invalid or unenforceable, it is to be read down to the extent that it is valid and enforceable and otherwise must be severed to extend of any invalidity or unenforceability, without affecting the remaining provisions of these Terms.
